THE SYSTEM OF PRINCIPLES OF ADMINISTRATIVE AND LEGAL ACTIVITIES OF PUBLIC AUTHORITIES TO PREVENT CORRUPTION IN UKRAINE: THEORETICAL AND LEGAL ASPECTS

Abstract

The study is devoted to the scientific substantiation of the system of principles of administrative and legal activities of public authorities aimed at preventing corruption in Ukraine. The article defines the theoretical aspect of the legal nature of the category “principles”. The author offers her own definition of the system of principles of administrative and legal activities of public administration bodies aimed at preventing corruption, which is presented as a set of internally structured, complex system of interrelated progressive prescriptions, the elements of which are determined by the fundamental values, tasks, strategies, action plans which are directly related to the organization of administrative and legal activities aimed at preventing corruption and, subject to which, the effective functioning of anti-corruption bodies is ensured.It is emphasized that the principles help to adapt the interests and needs of a person and society as a whole to the transformational processes that occur with the development of the state and lawmaking processes. They act as a social regulator, a measure of freedom and justice.The author emphasizes that in the system of principles of administrative and legal activities of public administration bodies aimed at preventing corruption, two classification groups of principles can be distinguished: national (national anti-corruption standards and principles of public administration) and international (principles of European law, European administrative law and European governance, international anti-corruption standards which contain the basic foundations of the fight against corruption).The author proposes that the system of principles of administrative and legal activities of public administration bodies aimed at preventing corruption should include: 1) general principles of law; 2) principles of constitutional law; 3) principles of modern administrative law;4) principles of service law, 5) principles of administrative procedure; 6) general principles of the EU; 7) European principles of administrative law; 8) principles formulated by the case law of the ECtHR; 9) principles of anti-corruption policy for 2021–2025; 10) principle of a single voice between the NAB of Ukraine and the SAP of the PGO.
