THE CONCEPT AND LEGAL NATURE OF MENTORING IN THE NATIONAL LEGAL SYSTEM

The article is devoted to the study of the concept and legal nature of mentoring in the legal system of Ukraine. In particular, the author distinguishes several understandings of the concept of mentoring, in particular: 1) as an activity aimed at providing assistance and support to children in institutional care facilities; 2) as a process whereby experience and knowledge are transferred from a more experienced person to a less experienced person, and this process is focused on certain educational or professional achievements; 3) as a relationship between a more experienced person and a less experienced person regarding the latter’s acquisition of knowledge and skills;4) as a form of social and psychological adaptation of children in institutional care facilities to independent living. Despite the absence of provisions in the Family Code of Ukraine on the regulation of mentoring legal relations, the latter can be conditionally attributed to the subject matter of family law regulation due to the fact that they find their dynamics within the institutional form of child placement, which is an integral element of the subject matter of legal regulation of family law. At the same time, the author concludes that it is impossible to give the legal relationship of mentoring a family law nature, based, in particular, on a) the specifics of the subject composition of the legal relations under study, namely, the center of social services for families, children and youth at the child’s place of residence, the mentor and the administration of the institution where the child lives; b) the grounds for their occurrence, namely, the legal composition which ends with the conclusion of a mentoring agreement; c) the content of the rights and obligations of the participants to the legal relationship on mentoring related to the mentor’s activities aimed at providing a child in an institutionalized care facility with social and psychological support and assistance not related to his/her upbringing in a family environment.
